Our total liability for any claims arising from our services shall not exceed the total fees paid by you for the specific services giving rise to the claim. This limitation applies regardless of whether the claim is based on contract, tort, negligence, or any other legal theory.

Nothing in these Terms shall exclude or limit our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay is due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, war, terrorism, or pandemic-related restrictions.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Croatia. Any disputes arising from or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Croatia, with venue in Rijeka.

If you are a consumer resident in another EU member state, you may also have rights under the consumer protection laws of your country of residence, and nothing in these Terms affects those rights.

Termination

Either party may terminate our service relationship at any time with written notice. Upon termination, you remain obligated to pay all fees for services rendered up to the date of termination. We will return any original documents provided by you and may retain copies as required by law or professional standards.

We reserve the right to terminate our services immediately if you breach these Terms, engage in illegal activities, or if continuing the relationship would violate applicable laws or professional standards.

Provisions relating to confidentiality, intellectual property, limitation of liability, and governing law shall survive termination of these Terms.

Amendments and Updates

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through our website. Your continued use of our services after such modifications constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you may terminate our service relationship.

Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving the original intent.

Entire Agreement

These Terms, together with our Privacy Policy and any individual service agreements, constitute the entire agreement between you and boldpeakify regarding the use of our services and supersede all prior agreements, understandings, or communications.
